1. About Us
The Smarter Car Hire Florida booking service ("Smarter Car Hire Florida", "we", "us", "our") is a trading name operated by:

Direct Villas UK Limited is not VAT registered. We are registered with the Information Commissioner's Office (ICO) under registration number Z3020380.
These Terms and Conditions constitute a legally binding agreement between you (the customer) and Direct Villas UK Limited, trading as Smarter Car Hire Florida. By completing a booking through our website, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions in their entirety.
2. Our Role as a Booking Agent
2.1 Our role
Smarter Car Hire Florida is a trading name of Direct Villas UK Limited (“we”, “us”, “our”). We provide an online booking service which enables customers to arrange car hire with third-party car hire providers.
We act as a booking agent. We are not the owner of the hire vehicles and we do not supply the car hire itself.
2.2 Your contracts
(a) Contract with us (booking service). When you place a booking on our website, you enter into a contract with us for the provision of our booking and administration service in relation to your car hire booking.
(b) Contract for the rental (car hire provider as principal). The hire of the vehicle is supplied by the car hire provider shown on your booking confirmation/rental voucher. Your rental agreement for the vehicle is made directly between you and the car hire provider and will be entered into at the point of vehicle collection. The car hire provider’s rental conditions (including driver requirements, deposits/excess, fuel policy and local charges) will apply to your rental.
2.3 Standard of service and responsibility
We will provide our booking service with reasonable care and skill (as required by the Consumer Rights Act 2015).
We are not responsible for the performance of the car hire provider’s obligations under the rental agreement (including the condition of the vehicle, conduct of staff, or local charges), except to the extent that any loss is caused by our failure to provide our booking service with reasonable care and skill.
2.4 Package Travel Regulations
We provide car hire booking services only. We do not sell or arrange package holidays or linked travel arrangements within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018. Those Regulations do not apply to your booking with us.
3. Eligibility to Book
3.1 UK Residency and Documentation
Smarter Car Hire Florida is available exclusively to residents of the United Kingdom. To be eligible to make a booking, you must hold both of the following valid and in-date documents at the time of booking and at the time of collecting the hire vehicle:
• A current UK passport (valid throughout the entire rental period)
• A current UK driving licence (valid throughout the entire rental period)
⚠ If you do not hold both a current UK passport and a current UK driving licence at the time of booking and collection, you do not meet our eligibility criteria and must not proceed with a booking through Smarter Car Hire Florida.
3.2 Minimum Driver Age
The minimum age to hire a vehicle through Smarter Car Hire Florida is 21 years. Drivers aged 21–24 may be subject to a young driver surcharge payable directly to the car hire provider at the point of collection. The amount of any such surcharge varies by provider and vehicle category and will be confirmed during the booking process.
3.3 Senior Drivers
There is no upper age limit for hiring a vehicle through Smarter Car Hire Florida. However, drivers aged 70 or over may be subject to a senior driver surcharge, the amount of which is determined by the individual car hire provider and is payable locally.
Drivers aged 75 or over are required to confirm the specific requirements of the relevant car hire provider before completing their booking, as some providers may require the presentation of a medical certificate or doctor's letter at the point of collection. It is the customer's sole responsibility to obtain any such documentation if required. Failure to present required documentation may result in the rental being refused.
3.4 Driving Licence Requirements
The following driving licence requirements apply to all bookings:
• Minimum Holding Period: All drivers must have held a full driving licence for a minimum of 12 consecutive months immediately prior to the date of collection.
• Photocard Licence: Holders of a current UK plastic photocard driving licence are not required to obtain an International Driving Permit (IDP) for use in Florida.
• Paper Licence: Holders of the old-style UK paper driving licence must obtain a valid International Driving Permit (IDP) before travelling. The IDP must be presented alongside the paper licence at the point of collection.
• All driving licence documents must remain valid and in date throughout the entire duration of the rental period.
3.5 Licence Endorsements and Convictions
While bookings are not automatically refused on the basis of minor driving licence endorsements, the following restrictions apply and are determined by the car hire provider's own policies:
• Major endorsements including, but not limited to, IN10 (driving without insurance) are likely to result in refusal of the rental by the car hire provider.
• Drivers with 6 or more penalty points on their licence may be refused rental at the discretion of the car hire provider.
• It is your responsibility to disclose all endorsements accurately during the booking process. Failure to do so may invalidate your booking without refund.
3.6 Additional Drivers
Additional drivers may be added to the rental agreement at the point of collection. An additional driver fee, payable directly to the car hire provider, may apply. All drivers must meet the eligibility criteria set out in this Section 3 and must present their valid driving licence at the rental desk.
4. The Booking Process
4.1 Online Booking
All bookings through Smarter Car Hire Florida are made exclusively via our website at www.smartercarhireflorida.com. To receive a quote and complete a booking, you must provide accurate and complete information, including:
• Full name of the lead driver
• Age of the lead driver (and any additional drivers)
• Valid driving licence details
• Pick-up and return locations
• Pick-up and return dates and times
• Valid flight number (for airport pick-up locations — see Section 10.3)
• Valid email address and contact telephone number
4.2 Booking Confirmation
A booking is confirmed when you receive a booking confirmation email from Smarter Car Hire Florida. This email will contain a unique booking reference number. Confirmation is sent prior to payment being taken. Please retain your booking confirmation email and reference number for the duration of your trip.
Please note that, depending on the availability processes of the end provider which is managed by a third party, there may be a period of between 5 minutes and 24 hours between submitting your booking request and receiving formal confirmation. We will notify you promptly once your booking has been confirmed by the provider.
4.3 Accuracy of Information
You are solely responsible for ensuring that all information provided during the booking process is accurate and complete. Smarter Car Hire Florida accepts no liability for any loss, additional cost, or refusal of rental arising from inaccurate or incomplete information provided by you.
5. Price Information
5.1 Quoted Prices
All prices quoted on our website represent the total cost of the car hire rental for the period selected, inclusive of all compulsory charges such as applicable taxes and mandatory location fees. Any optional extras (for example, child seats or additional drivers) will be clearly itemised separately.
Prices are displayed in pounds sterling (GBP). Some locally payable charges (for example, one-way fees, out-of-hours fees, or young/senior driver surcharges) are payable directly to the car hire provider at the point of collection and are not included in the price quoted at the time of booking.
5.2 Fuel Policy
All car hire providers available through Smarter Car Hire Florida operate a fair fuel policy. The standard policy is full-to-full or same-to-same, meaning you collect the vehicle with a full (or stated level) tank and are required to return it at the same level to avoid additional charges. The specific fuel policy applicable to your booking will be confirmed on your booking page and voucher.
Smarter Car Hire Florida, through Zest Car Rental, monitors provider compliance with fuel policies via customer feedback. If you experience a fuel policy issue, please report it to us in accordance with Section 16.
6. SmartTrack — Automated Price Monitoring
Following confirmation of your booking, Smarter Car Hire Florida will automatically monitor the cost of your specific rental using our proprietary SmartTrack system.
6.1 How SmartTrack Works
SmartTrack is a fully automated price monitoring system that tracks the cost of your confirmed booking from the point of confirmation by the end provider through until and including the day prior to the final payment date as shown on your booking documentation and emails. If the rental rate for your exact booking reduces by £10.00 or more, we will automatically amend your booking to the new lower rate.
• No action is required from you.
• You will be notified of any price reduction by email.
• The reduced rate will be the final price charged for the rental period.
• Price reductions are applied automatically; no manual claim is required.
6.2 Important Limitations
Please note the following important limitations of the SmartTrack system:
• SmartTrack monitors prices from the date of booking confirmation. There is no assurance or representation that a price reduction will occur.
• Price increases following booking confirmation will not affect the price you pay.
• The minimum price reduction threshold for an automatic rebooking is £10.00.
• SmartTrack does not apply to the security deposit, optional extras, or any locally payable charges.
• At this time there are no provider-imposed blackout periods that would prevent a price reduction being applied, but we reserve the right to update this position if provider terms change.
The SmartTrack system is an automated feature provided as part of our service. It does not constitute a price guarantee. Smarter Car Hire Florida makes no representation that any particular booking will benefit from a price reduction.
7. Payment
7.1 Payment methods and processing
Payment for bookings made on our website is taken by Direct Villas UK Limited. Payments are processed securely using an online payment system provided by Opayo (formerly Sage Pay).
We accept payment by debit card and credit card. Payments are processed in pounds sterling (GBP) unless we state otherwise during the booking process.
7.2 When payment is due
No deposit is taken at the point of booking.
The full balance is due no later than six weeks prior to your scheduled collection date. We will notify you of the payment due date in your booking confirmation email (or otherwise in writing).
If we do not receive payment by the due date, we may cancel your booking. If we cancel due to non-payment, any refund will be determined in accordance with Section 8 (Cancellation Policy) and any irrecoverable costs we have incurred in relation to your booking.
7.3 Security deposit at collection
A security deposit is usually required by the car hire provider at the point of collection. This deposit must be paid using a valid credit card held in the name of the lead driver (not a debit card or prepaid card), unless the provider’s rental conditions expressly permit otherwise.
The amount of the deposit is set by the car hire provider and will be shown in the provider’s rental conditions and/or on your rental voucher. The deposit is taken and held by the car hire provider and is released by the provider following return of the vehicle, subject to the provider’s terms (including any damage or additional charges).
7.4 Charges payable at collection
Some charges are not included in your quoted price and may be payable directly to the car hire provider at collection (or otherwise locally) depending on the provider’s rental conditions. These may include (where applicable):
young driver surcharges;
senior driver surcharges;
out-of-hours collection/return fees;
one-way rental fees;
optional extras (child seats, GPS, etc.);
airport or location surcharges (where applicable).
We will provide information about such charges where supplied to us by the car hire provider, but you must check the provider’s rental conditions carefully.
8. Cancellation Policy
8.1 How to cancel
If you wish to cancel your booking, you must notify us directly. Cancellations cannot be accepted via the car hire provider.

8.2 Statutory cancellation rights (Consumer Contracts Regulations 2013)
Because car hire is a service relating to leisure activities provided for a specified date or period, the 14-day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply.
This does not affect our cancellation policy below.
8.3 Cancellation fees
The following cancellation charges apply:
More than 48 hours before the scheduled pick-up date and time: 0% cancellation fee (full refund).
Less than 48 hours before the scheduled pick-up date and time: a cancellation charge of 50% of the total booking price, capped at £50 (or €55 where the booking was priced in euros).
No-show: no refund.
8.4 Definition of no-show
A “no-show” includes (without limitation) where:
you fail to collect the vehicle at the specified date and time without prior notification to us; or
you fail to meet the car hire provider’s material rental requirements at the desk (for example, failing to present required documentation such as a valid driving licence and a credit card in the lead driver’s name); or
you fail to notify the car hire provider (and where relevant us) of a flight delay and the provider’s waiting period expires.
8.5 Refund processing
Where a refund is due, it will be returned to the debit or credit card used to make the original payment. We will process refunds within 48 hours of receiving your valid cancellation request, although it may take longer to appear on your statement due to your card issuer’s processing times.
9. Amendments to Bookings
If you wish to amend your booking (for example, to change your pick-up date, vehicle category, or pick-up/return location), you must contact Smarter Car Hire Florida directly. Amendments cannot be requested via the car hire provider or Zest Car Rental. Please contact us.

Please clearly set out the nature of the amendment requested. We will endeavour to accommodate your request, subject to availability and the policies of Zest Car Rental and the end car hire provider. Amendments may result in a change to the price of your booking, which will be confirmed to you before any change is finalised. We cannot guarantee that all requested amendments can be accommodated.
10. Vehicle Collection
10.1 Required Documentation at Collection
At the point of vehicle collection, the lead driver must present the following to the car hire provider's desk:
• Your original valid UK driving licence (photocard or paper + IDP where applicable)
• Your current valid UK passport
• A valid credit card (not debit card or prepaid card) in the lead driver's name, for the security deposit
• Your Smarter Car Hire Florida booking voucher (printed or digital)
⚠ Failure to present any of the above documents may result in the car hire provider refusing to release the vehicle. In such circumstances, the booking will be treated as a no-show and no refund will be due.
10.2 Pick-Up Procedures
Your booking voucher will confirm your specific pick-up procedure, which may include:
• In-terminal rental desk — collect at the provider's desk within the airport terminal
• Meet and greet — a representative will meet you at the terminal
• Off-airport shuttle — a courtesy shuttle will transfer you to an off-site depot
10.3 Airport Collections — Flight Numbers
A valid flight number is required at the time of booking for all airport pick-up locations. Providing your flight number allows the car hire provider to track your arrival and reduces the risk of your booking being treated as a no-show in the event of a delay.
• Flight Delays: If your flight is delayed or cancelled, you must notify Smarter Car Hire Florida immediately on +44 (0)1325 808 123 so that we can inform the provider.
• No-Show Risk: If you are delayed and have not provided a flight number or notified us of the delay, the provider may reassign your vehicle. This will be treated as a no-show and no refund will be due.
• Non-Air Arrivals: A flight number is not required if you have specifically requested a non-airport "walk-in" collection and this has been confirmed in your booking.
10.4 Out-of-Hours Collection and Return
Out-of-hours collections and returns are available at certain locations, subject to an additional fee payable directly to the car hire provider at the point of collection. Any applicable out-of-hours fees will be displayed during the booking process and confirmed on your voucher.
• If a flight delay pushes your arrival into out-of-hours, the provider may charge an additional fee. The provider is not obliged to wait indefinitely.
• If an out-of-hours collection cannot be accommodated, the collection will be rescheduled to the next available business day. In such circumstances, Smarter Car Hire Florida will not be liable for any additional costs incurred.
10.5 Rental Agreement at Collection
You will be required to read and sign the car hire provider's rental agreement at the point of collection. This agreement is a separate contract between you and the car hire provider. It governs important matters including insurance, fuel policy, vehicle condition, and any additional charges. You are strongly advised to read this agreement carefully before signing.
11. One-Way Rentals
One-way rentals (where the pick-up and return locations differ) are available through Smarter Car Hire Florida, subject to provider availability. One-way rentals are subject to a one-way fee, which is typically paid directly to the car hire provider at the point of collection. This fee is not included in your quoted price and will be confirmed on your booking voucher.
Cross-border travel (including taking the vehicle outside the United States) and the transportation of vehicles on ferries must be declared to, and approved in writing by, the relevant car hire provider before departure. Undertaking such travel without prior approval will invalidate your insurance coverage.
12. Florida Tolls
The State of Florida operates a cashless tolling system. Roads are monitored electronically, and cash is not accepted at the majority of toll plazas. The main tolling systems in operation are:
• SunPass — Florida's primary prepaid electronic tolling system
• E-PASS — operated by the Central Florida Expressway Authority
• Toll-by-Plate — a photographic system that invoices the registered owner (in this case the car hire provider) where no transponder is detected
Your car hire provider will offer a transponder rental service. Using a rented transponder is generally the most cost-effective option. If you incur tolls via the Toll-by-Plate system, the car hire provider will charge these to your credit card after the rental, typically with an additional administration fee. Details of the provider's toll policy will be set out in the rental agreement at collection.
Toll charges and any associated administration fees are entirely the responsibility of the customer and are not included in your booking price.
13. Insurance and Coverage
13.1 Included as Standard
The following insurance products are included as standard in all bookings made through Smarter Car Hire Florida:
• Collision Damage Waiver (CDW): Limits your liability in the event of damage to the rental vehicle.
• Theft Waiver (TW): Limits your liability in the event of theft of the rental vehicle.
• Supplemental Liability Insurance (SLI): Provides additional third-party liability cover as required under Florida law.
• Zero Excess: Smarter Car Hire Florida includes zero excess liability as standard on all rentals. In the event of an insured collision or theft, you will not be required to pay a standard excess amount (USD $0 / GBP £0). This is provided through no-excess policies or Excess Reimbursement Insurance (ERI) arranged through Zest Car Rental.
13.2 Excess Reduction and Waiver Products
Smarter Car Hire Florida does not offer any standalone excess reduction or waiver products beyond the zero excess protection included as standard in all bookings under Section 13.1. No additional excess reduction product is available for purchase through Smarter Car Hire Florida at the time of booking or at any other point in the booking process.
The zero excess protection provided under Section 13.1 — delivered through no-excess policies or Excess Reimbursement Insurance arranged through Zest Car Rental — constitutes the complete extent of excess liability protection included with your booking. Customers who require additional personal accident cover or medical expense cover beyond that provided by the included SLI should ensure they hold appropriate travel insurance before travelling.
13.3 Personal Accident Insurance (PAI)
Personal Accident Insurance (PAI) is not included in any booking made through Smarter Car Hire Florida. All customers are strongly advised to ensure that they have adequate and appropriate holiday/travel insurance in place before travelling to the United States of America. Your travel insurance should include, as a minimum:
• Medical expenses and repatriation cover
• Personal accident cover
• Cancellation and curtailment cover
⚠ Travel to the United States of America without comprehensive travel insurance is strongly inadvisable. Medical treatment costs in the USA can be significant. Smarter Car Hire Florida accepts no liability for any costs arising from inadequate travel insurance coverage.
13.4 Exclusions from Insurance Coverage
Insurance cover included in your booking does not extend to, and the customer remains liable for:
• Damage to tyres, wheels, windscreens, or the underside of the vehicle (unless specifically covered by the provider's policy)
• Damage caused by driving under the influence of alcohol or drugs
• Damage caused by driving on unpaved roads or terrain not permitted under the rental agreement
• Damage caused by reckless driving or deliberate misuse
• Cross-border or ferry use without prior written approval
• Any additional items declared and confirmed in the rental agreement at collection
14. Customer Responsibilities
In addition to the responsibilities set out elsewhere in these Terms and Conditions, you are responsible for:
• Ensuring all information provided during the booking process is accurate and complete.
• Reading and understanding the rental agreement before signing it at the collection desk.
• Complying with all terms and conditions of the car hire provider's rental agreement.
• All traffic fines, penalties, and infringements incurred during the rental period.
• All toll charges and any associated administration fees.
• Refuelling charges where the vehicle is returned with less fuel than at collection (under a full-to-full or same-to-same policy).
• Any damage to the vehicle not covered by the included insurance products.
• Ensuring the vehicle is returned on time and in the condition it was collected.
15. Supplier Failure
Smarter Car Hire Florida works exclusively through Zest Car Rental, which operates a proactive supplier vetting programme. Zest Car Rental continuously monitors the performance and financial health of its car hire provider partners, placing providers under review if performance standards fall and removing them if improvements are not made.
In the event that a car hire provider suffers a failure (including insolvency, overbooking, or operational failure), Smarter Car Hire Florida is reliant on timely notification from Zest Car Rental. We will use reasonable endeavours to notify affected customers and to assist in sourcing an alternative booking where possible.
Please note that Smarter Car Hire Florida does not hold ATOL protection, ABTA membership, or travel insurance in respect of supplier failure. In the event of a supplier insolvency, any claims for reimbursement may need to be directed to your credit card provider under Section 75 of the Consumer Credit Act 1974 (where applicable) or via your travel insurance provider.
We strongly recommend that all customers hold a comprehensive travel insurance policy that includes supplier failure/end supplier failure cover before making a booking.
16. Liability
16.1 Our Liability to You
Smarter Car Hire Florida is liable for loss or damage you suffer as a direct result of our failure to provide our booking service with reasonable care and skill, as required by the Consumer Rights Act 2015.
Nothing in these Terms and Conditions limits or excludes our liability for:
• Death or personal injury caused by our negligence or the negligence of our employees or agents
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be limited or excluded by law
16.2 Limitation of Our Liability
Subject to Clause 16.1, our total liability to you in respect of our booking service (whether in contract, tort, or otherwise) shall not exceed the total amount paid by you to Smarter Car Hire Florida for the relevant booking.
16.3 Matters Beyond Our Control
We are not liable for any loss, damage, or additional cost arising from matters beyond our reasonable control, including but not limited to:
• The condition, mechanical reliability, or roadworthiness of the rental vehicle
• Actions or omissions of the car hire provider or Zest Car Rental
• Overbooking by the car hire provider
• Events of force majeure (including natural disasters, acts of terrorism, pandemics, or government action)
• Your failure to present required documentation at collection
17. Complaints Procedure
17.1 Complaints about our booking service

We will acknowledge your complaint within 5 working days and aim to provide a substantive written response within 28 days of receipt. If a complaint is complex, we will keep you updated.
17.2 Complaints about the car hire provider
Complaints relating to the rental vehicle or the car hire provider’s performance under the rental agreement should be raised with the relevant car hire provider first, in accordance with the provider’s rental conditions. If you are unable to resolve the issue, contact us and we will use reasonable endeavours to assist.
18. Alternative Dispute Resolution (ADR)
We are not currently a member of, and do not participate in, an Alternative Dispute Resolution (ADR) scheme. We are therefore not obliged to refer disputes to an ADR provider.
You may obtain free, independent advice from Citizens Advice (www.citizensadvice.org.uk / 0808 223 1133).
Nothing in these Terms affects your legal rights, including your right to bring proceedings in court.
19. Data Protection
19.1 Data Controller
The Data Controller for personal data collected through this website and booking service is Direct Villas UK Limited (trading as Smarter Car Hire Florida). The named Data Controller is Mr Robert Gardner (Director). Our ICO registration number is Z3020380.
Our full and standalone Privacy Policy is available at www.smartercarhireflorida.com/privacy-policy and should be read in conjunction with these Terms and Conditions.
19.2 Personal Data We Collect
In order to process your booking, we collect and process the following categories of personal data:
• Full name, home address, telephone number
• Email address
• Age and date of birth
• Sex
• Driving licence details
• Passport details
• Payment card information (processed securely by Opayo; we do not store full card details)
• IP address and website usage data
• Booking and transaction history
19.3 Legal Basis for Processing
We process your personal data on the following legal bases under the UK GDPR:
• Performance of a Contract (Article 6(1)(b)): Processing is necessary to fulfil your booking and to provide our booking service.
• Legitimate Interests (Article 6(1)(f)): Processing is necessary for the management of bookings, provision of customer service, fraud prevention, and the ongoing operation of our business.
• Legal Obligation (Article 6(1)(c)): Where processing is required to comply with a legal obligation (for example, tax and financial records).
19.4 Data Sharing
We will share your personal data only with the following third parties, and only to the extent necessary to fulfil your booking:
• Zest Car Rental — to process and manage your car hire booking
• The relevant car hire provider (Alamo, Hertz, Dollar, Thrifty, Enterprise, Sixt, or National) — to facilitate the rental
• Opayo — for secure payment processing
• Microsoft / SendGrid — for email communications relating to your booking
19.5 International Data Transfers
Your personal data may be transferred to, and processed in, the United States of America in connection with your car hire booking. Such transfers are made in reliance upon the UK Extension to the EU-US Data Privacy Framework (the "UK-US Data Bridge"), which came into effect on 12 October 2023. This framework permits UK personal data to be transferred to certified US organisations without the need for additional safeguards.
The transfer of your data to US-based car hire providers is facilitated through and managed by Zest Car Rental as part of their data processing arrangements. Details of Zest Car Rental's data processing arrangements can be found in their privacy documentation.
19.6 Retention Period
We retain your personal data for a period of six (6) years following the conclusion of your booking, in accordance with our obligations under applicable tax and financial legislation. Following the expiry of this retention period, your data will be securely deleted or anonymised.
19.7 Your Rights
Under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, you have the following rights:
• Right of access — to request a copy of the personal data we hold about you
• Right to rectification — to request correction of inaccurate data
• Right to erasure — to request deletion of your data (subject to legal retention obligations)
• Right to restrict processing
• Right to data portability
• Right to object to processing based on legitimate interests

20. Governing Law and Jurisdiction
20.1 England and Wales
These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
Subject to Clause 20.2 and Clause 20.3, each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions.
20.2 Scotland
If you are resident in Scotland, you may bring proceedings in the Scottish courts. These Terms and Conditions shall be governed by the laws of England and Wales, but your statutory rights as a consumer under Scots law are unaffected.
20.3 Northern Ireland
If you are resident in Northern Ireland, you may bring proceedings in the courts of Northern Ireland. These Terms and Conditions shall be governed by the laws of England and Wales, but your statutory rights as a consumer under Northern Irish law are unaffected.
21. Statutory Rights
Nothing in these Terms and Conditions is intended to, or shall, limit or exclude any of your statutory rights as a consumer under the laws of England and Wales (or Scotland or Northern Ireland, as applicable), including but not limited to your rights under:
• The Consumer Rights Act 2015
• The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013
• The Consumer Protection from Unfair Trading Regulations 2008
• The Equality Act 2010
• The Digital Markets, Competition and Consumers Act 2024
To the extent that any provision of these Terms and Conditions is found to be unfair, unreasonable, or unenforceable under applicable consumer law, that provision shall be severed from the remainder of the Terms and Conditions, which shall continue in full force and effect.
22. General Provisions
22.1 Entire Agreement
These Terms and Conditions, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between you and Smarter Car Hire Florida in relation to your booking and supersede all previous communications, representations, or agreements.
22.2 Amendments to These Terms
Smarter Car Hire Florida reserves the right to update or amend these Terms and Conditions from time to time. The Terms and Conditions in force at the time of your booking will apply to that booking. We recommend that you review these Terms and Conditions each time you make a new booking.
22.3 Waiver
No failure or delay by Smarter Car Hire Florida to enforce any provision of these Terms and Conditions shall constitute a waiver of our right to do so.
22.4 Assignment
You may not transfer or assign any of your rights or obligations under these Terms and Conditions without our prior written consent. We may transfer our rights and obligations under these Terms and Conditions to another organisation but this will not affect your rights under these Terms and Conditions.
